1. Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and myrecipe ("we," "us" or "our"), concerning your access to and use of the myrecipe website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").
2. Intellectual Property Rights
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.
3. User Representations
By using the Site, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms of Service.
4. Payment and Fees
We use Stripe as our third-party payment processor. By providing a credit card or other payment method, you represent and warrant that you are authorized to use the designated payment method and that you authorize our payment processor to charge your payment method for the total amount of your subscription or purchase (including any applicable taxes and other charges).
We reserve the right to change our prices at any time. We will provide notice of the change on the Site or in email to you, at our option, at least 30 days before the change is to take effect.
5. Lifetime Membership Terms
The Lifetime Membership is a one-time payment that grants you access to all Family plan features for as long as the myrecipe service continues to operate. By purchasing a Lifetime Membership, you acknowledge and agree to the following terms:
- Definition of "Lifetime": "Lifetime" refers to the operational lifetime of the myrecipe service, not the lifetime of the purchaser. Access will continue for as long as myrecipe remains in active operation.
- Features Included: Lifetime members receive access to all features included in the Family plan at the time of purchase, plus any future updates and enhancements we make to the Family plan.
- Family Members: Lifetime Membership includes access for up to 4 family members. Additional family members may be added at the then-current per-member rate.
- No Refunds: Due to the nature of the Lifetime Membership, all sales are final. Refunds will not be issued except as required by applicable law.
- Non-Transferable: Lifetime Memberships are personal to the purchaser and may not be sold, transferred, or assigned to another party.
- Service Discontinuation: In the unlikely event that myrecipe ceases operations permanently, we will provide at least 90 days notice and offer a data export option. No refunds or compensation will be provided for remaining "lifetime" access.
- Account Termination: We reserve the right to terminate accounts that violate our Terms of Service. In such cases, the Lifetime Membership is forfeited.
- Future Services: Lifetime Membership applies to the myrecipe service as it exists. Separate products, services, or spin-offs we may create in the future are not included unless explicitly stated.
6. Third-Party Advertisers
We may use third-party advertising companies to serve ads when you visit the Site. These companies may use information about your visits to the Site and other websites that are contained in web cookies in order to provide advertisements about goods and services of interest to you.
We work with partners such as Google AdSense, Google Ads, and Facebook Ads. Your interactions with these features are governed by the privacy policy of the company providing it.
7. Limitation of Liability
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site, even if we have been advised of the possibility of such damages.
